Generalni sekretar KS BIH, Amer Čolan, nam je proslijedio kompletnu prepisku mailovima sa Nikolinom Zubac, koja je danas objavila da napušta reprezentaciju na neođređeno.

– Informacije radi igračica je potvrdila Team Manageru reprezentacije Raziji Mujanović dolazak u reprezentaciju nakon objavljivanja spiska 30 dana prije početka priprema.

KSBIH je 26.10.poslao kartu igračici i informacije klubu u kojem igra o njenom dolasku i povratku kao i instrukcije za PCR test što nalaže Fiba protokol u vezi testiranja .

Danas smo na engleskom dobili mail koji Vam šaljem u prilogu iz kojeg je vidljivo da nije pisan od strane igračice.

Naravno tu je i odgovor koji sam uputio na njen email koji je ona objavila na profilu kako bi ispalo da mi nemamo razumjevanja u vezi njenih problema sa Vizom. Klub i Menađžer trebaju brinuti o radnim dozvolama i dokumentaciji igrača koja je potrebna za registraciju.

Igrač se nalazi u prekršaju nema radnu dozvolu i vizu a igra u Čehoslovačkoj i prebacuje svoj problem na savez i još priznaje da je dva puta bila vračena zbog nevažečie dokumentacije za ulazak.

Prvi mail koji je Nikolina poslala danas a to je 4 dana nakon što je dobila kartu i obavijest za dolazak i to na engleskom prema Savezu što je očito da je pisao njen menadžer, govori Amer Čolan.

– Dear Sir’s/Madam’s,

I am writing you in relation to my convocation to the Bosnian National Team for the November break window. In this regards, I wish to state that I know the rules, rights and obligations that a player has in accordance to the FIBA Internal Regulation Book 3 and that a player is obliged to become available for National Team purposes according to such by-laws.

Yet however unfortunately my situation is as follows:

– I am currently in Czech Republic, which is in a state of emergency

– Due to the state of emergency, my club has not yet been able to finalize my Schengen visa

– If I will travel outside of Czech Republic and of the Schengen area, I will be unable to return back to Czech Republic without a valid visa per the current in place rules

– Also in the month of September 2020, I had been denied boarding in 2 times (once in Sarajevo airport, once in Podgorica airport) for this reason, only a third time being “lucky” in being able to travel to Czech Republic.

I can present evidence needed to all of these affirmations, should this be necessarily.

I believe that this by-laws, rules and obligations were drafted for “normal” times, not times in which there is a world pandemic and such rules to not imply the obligation of the player to throw away their financial livelihood for being present in a National Team action.

Thus, while I am also aware that my club is responsible for processing my visa and they maybe mishandled these proceedings (as they could had done it earlier, which they indeed haven’t) I am also unable to support the costs of a BAT case (which are not cheap at all) in the case in which after my travel to Bosnian National Team I would be unable to return back to Czech Republic and my current club won’t furthermore pay me. Similarly, also I would be in not easy position in that hypothesis to seek another employment for multiple reasons (I would be under a valid contract with a team being one of it and not even the biggest barrier, as in this times for players out of the European Union basically virtually no team is signing players with such origin due to visa constrains in difficult times and with Czech Republic, France, Spain, Germany, Slovenia already announcing state of emergencies in place or commencing next week and many other countries warming up in this topic too).

For this reasons (which are special circumstances and it is not in my desire for this to happen, I wish I would have a visa and be able to travel !!!), unfortunately, I wish to inform the Bosnian Federation and FIBA too that in the case I would not have a valid Schengen visa until the date in which I would need to present myself to the Bosnian National Team, I would be unable due to this special circumstances to honor the convocation.

I informed the Bosnian Federation about my special circumstances and their reply was simple: that they do not care about my situation and that there are FIBA rules to respect.

In this respect, I wish to bring this matter in the attention of the FIBA General Secretary, which is in my hope that would understand this special circumstances and would exceptionally decide to not apply any sanction in relation to this aspects, especially since in the end FIBA had always manifested understandement towards players which are not with bad-faith choosing to ignore their obligations under the applicable regulations, but for justified purposes, in exceptional manner and in very specific special circumstances are from a practical way unable to do so (or if they are unable to do so, the collateral damage to their career/financial status/situation outweigh the benefits of a National Team to have them under command for a specific action).

Also I want to express towards the Bosnian Federation the fact that I am not happy with this situation and that I wish I could be able to honor such convocation to the National Team (which there is still a chance I could, if I would have visa until then, but slim because Czech Republic authorities suspended this services in the state of emergency…) and that it is not my desire to not come to my national team (but the opposite) and that only because of these circumstances I apparently may unable to – this time – to honor such convocation.

My good faith is also proven by the fact that I am not trying to avoid the NT actions in the future (otherwise, for this problem that I have now and for other problems, the solution would had been simple and unable to be contested : a formal declaration of retiring from Bosnian NT actions, yet as mentioned I wish to be part of this NT just in this specific window due to specific extraordinary circumstances I will apparently be unable to be present this time and this time only).

Thus in order for this matter to not become a contradictorily one, I would appreciate the Bosnian National Federation to withdraw the convocation in relation to my person should I have no visa until the date in which I need to travel (which probably is 99% the case) and, if not, I would kindly wish in that negative matter, for FIBA Secretary General to have the courtesy to specify if given these extraordinary circumstances I could be excused from the application of any sanctions.

Amer Čolan zatim šalje i odgovor na mail.

– Dobar dan Nikolina,

Primili smo tvoje pismo koje si nam poslala i odmah na startu moram reci da je jako neozbiljno pisati mail na Engleskom prema matičnom savezu i u naslovu maila ne staviti nikakav naslov kome i za sta se isti naslovila.

Pretpostavljam da ti nisi ni pisala ovaj email pa evo ukratko cu ti i odgovoriti a vjerujem da te vec kontaktirala Razija po ovom pitanju.

Kosakraski savez ce pokrenuti suspenziju ukoliko se ne odazoves na pripreme za koje si potvrdila da dolazis i za koje smo ti vec kupili i poslali kartu a ti si potvrdila dolazak. Takodje je nemoguce da ighras a da ti klub nije sredio i zavrsio dokumentaciju sto je jos jedan prekrsaj i obavijesticemo FIBU vezano za tvoj slucaj.

Ostalo zaista ne bih komentarisao na tebi je da se odlucis i da u roku od 24 sata javis da li dolazis ili ne na okupljanje – naravno koristi Bosnaski jezik za komunikaciju sa savezom.

Dear Sirs and Madams,

In continuation of my previous e-mail in which I described the unfortunate circumstances in which I am into and that in reply to this instead of compassion and understanding, I had received nothing else than pressure and legal threats from the Bosnian Federation (see their e-mail in original copy attached and in translation in English language); given these aspects and that I no longer identify myself with the values that apparently the Bosnian Federation decides to support, I duly wish to hereby notify the Bosnian Federation that I decide to retire from the Bosnian National Team, effective immediately and indefinitely.

Hello Nikolina,

We received your letter that you sent us and right at the start I have to say that it is very frivolous to write an e-mail in English to the parent union and not put any title in the subject of the e-mail to whom and for what the same titles.

I assume that you did not even write this email, so I will answer you briefly and I believe that Razija has already contacted you on this issue.

The Kosakra Alliance will initiate a suspension if you do not respond to the preparations for which you have confirmed that you are coming and for which we have already bought and sent you a ticket and you have confirmed your arrival. It is also impossible for you to go without your club arranging and completing the documentation, which is another offense, and we will inform FIBA regarding your case.

The rest I really wouldn’t comment on is that you decide and let us know within 24 hours whether you are coming or not to the gathering – of course he uses the Bosnian language to communicate with the alliance.

– KSBIH neće dozvoliti menadžerima da minipulišu igračicama i da im brane igranje i nastup za reprezentaciju i tiome pravdaju svoje greške koje su napravili i nisu im završili radne dozvole.

Toliko od mene i nemam namjeru komentarisati dalje ovaj slučaj poslaće se dopis FIBI u vezi suspenzije igračice i klubu u kojem igra sa pitanjima kako je moguće da neko bude registrovan i igra prvenstvo bez radne dozvole i vize u zemlji u kojoj boravi pogotovo kad se radi o profesionalnom igraču.
